Under Ontario law, you must be 19 years of age or over to purchase alcohol products. In submitting your order, you are representing yourself as being of legal drinking age in Ontario. In accordance with AGCO regulations, valid government photo ID will be requested upon pickup. If you are unable to verify your age by presenting valid identification at the time of pickup, all alcohol ordered will be removed from your order. Alcoholic products are available for pickup between 7am and 11pm.

E-commerce terms of use relating to our Food Basics e-commerce site ("Transactional Site")

This website, including the Transactional Site, social media, mobile applications and other platforms belonging to Metro (collectively, the "Site"), is owned and operated by Metro Inc. its affiliates and subsidiaries (“Metro”), having its head office at 11011 Maurice-Duplessis Boulevard, in Montréal, province of Quebec, H1C 1V6. By accessing and using this Site, you unconditionally agree to be bound by the Terms of Use of the Site and by these terms of use relating the use of the Transactional Site, as they may be amended from time to time by Metro (the "Terms") and all applicable laws. Use of our Site is limited to personal, non-commercial use.

To place an order on our Transactional Site you need to have or create a account and log in. You must make sure that your information is up-to-date at all times. By placing an order, you acknowledge and agree to the Terms. The Terms, together with any documents they expressly incorporate by reference, including, without limiting the generality of the foregoing, the Protection of Personal Information Policy, constitutes the entire agreement relating to your use of the Transactional Site and the fulfillment of your order between you, on one hand and on the other hand, Metro and the designated Food Basics store ("Designated Store") that will be assigned to fulfill your order.

In the event of conflict between the terms and conditions of the above-noted documents, the Transactional Site e-commerce terms shall prevail with respect to any use of the Transactional Site. All other conditions, verbal or written, that the buyer might add to an order or other document that would alter these Terms are specifically excluded and considered null and void. Metro reserves the right however to subject the sale of products and services to additional conditions which would be communicated at the time of purchase. The purchase receipt issued by the store where your order was prepared shall prevail over communications regarding your order.

Metro reserves the right, at its sole discretion and for whatever reason, to refuse or cancel any on-line order or to ask you for additional information before accepting or refusing any on-line order or payment, in which case you would be notified by e-mail. Metro shall be under no obligation to fulfill any such order and shall not be liable for any damages whatsoever resulting from its refusal or cancellation of an online order. You shall not have to pay for any such refused or cancelled order.

Your order: Metro cannot guarantee that all of the products that you order are available at the time of order and therefore your total order cannot be determined until it has been assembled given the weights and cuts of certain products, prices, discounts and coupons, all of which are validated during the order’s assembly. It is understood that the Web catalogue of products for sale on the Transactional Site does not constitute an offer to sell but rather an invitation to place an order. For the same reasons, an order confirmation shall not be considered an acceptance of the offer. The sales contract shall be concluded when assembly of your order at the Designated Store is finished and payment by you has been completed. You consent to the assignment by Metro of all its rights and obligations in your order to the Designated Store which shall see to the assembly of your order, receive payment from you and allow for pick-up, if applicable. Consequently, your invoice will be issued by the Designated Store, not by Metro.

Unauthorized commercial use: The Transactional Site is for personal, non-commercial use only. Metro reserves the right, at all times and for whatever reason, to limit quantities of products purchased by a person, by account, by billing address or otherwise.

You must be of full legal age in your province of residence to place an order on our Transactional Site. The person picking up your order must have ID and, if the order includes one or more age-restricted products (including but not limited to, alcohol), proof of full legal age in their province of residence.

Order pick-up: The order pick-up is provided only by the participating stores indicated on our Site. When placing an order, you have to specify the pick-up at one of our participating stores. You also have to select a time slot for pick-up.

When you pick up your order in your time slot at the Designated Store, you may park your vehicle in the indicated pick-up spaces. If your vehicle is legally stationary, you may call the phone number indicated in the parking lot and the order will be brought out to your vehicle. You may also come to the checkouts to inform us of any desired changes, including the issue of deferred vouchers for any missing products. Please stick to your pick-up time slot.

Modifications to your order: You may always modify or cancel an order by submitting your changes before the deadline indicated when your order is confirmed. You can also modify the products in your order at the store. If you change your time slot for pick-up, prices, discounts, promotions, coupons and fees may differ depending on those in effect at the time of your order’s assembly. Metro reserves the right to charge cancellation fees for any order cancelled after the deadline indicated in the order confirmation or any order that was not picked up. For any post-deadline modifications to your online order, contact Customer Service as soon as possible at 1‑866‑595‑5554.

Modifications and substitutions by Metro: Metro reserves the right to modify any order should products be unavailable for whatever reason. If you indicated that you accept substitutions of a product, you will always have the opportunity to accept or refuse the substitution upon pick-up, or later through product return. If you indicated that you do not accept substitutions of a product and the ordered products are unavailable, these products will not be part of your order and you will not be charged for them. Metro reserves the right, when products are unavailable, to make certain size, brand or flavour substitutions which you can accept or refuse. Metro shall be under no obligation to provide advance notice of product substitutions or withdrawals. However, you will be informed of any such substitutions or withdrawals by e-mail once your order has been assembled. Metro shall not be responsible for checking the presence of any allergens whatsoever in any products or substitute products. Responsibility for the presence of allergens is solely yours, even should Metro have prior notice of same. For more information on substitutions, please see our FAQ.

Prices, discounts, promotions, coupons and taxes: All prices are in Canadian dollars. Prices, discounts, promotions and coupons may vary between the Transactional Site, our stores and the Designated Store responsible for the assembly of your order. The prices, discounts, promotions and coupons of the Designated Store at the time of assembly of your order will take precedence over any other prices indicated on our Site or order confirmation. The prices, discounts, promotions and coupons of products featured in our flyer, are effective from the Thursday indicated to the following Wednesday inclusively (the "Period") for orders to be picked-up during the same Period. When an order is placed in a Period and the selected time slot for picking it up falls outside that Period, the prices, discounts, promotions and coupons are subject to change and will be those of the Period in which pick-up takes place.

Unit prices given on the Transactional Site for products sold by weight or cut are only estimates. At the time of your order’s assembly and payment, the actual price will be charged and appear on your invoice.

Coupons, and other discounts must be in effect at the time of payment of your order and may not exceed the total cost of your order.

Coupons are subject to the terms and conditions on the coupons, in addition to these Terms.

Please note that alcohol is not included in promotions offered with promotional codes, nor is it included in the required minimum amount for the use of codes on the site.

Only coupons downloaded and reproduced from this Site or our mobile app and authentic paper coupons shall be accepted in stores.

Only digital coupons appearing on the Site may be used for an online order. When placing an online order, add applicable coupons by clicking on each coupon. Digital supplier coupons and paper coupons cannot be used with online orders.

Incomplete, illegible, electronically or physically altered, fraudulent or otherwise corrupted coupons as well as coupons not downloaded or reproduced from our Site or mobile app or that have been modified or falsified shall be rejected.

Metro, through its Food Basics banner, honours its customer promise “Always Fresh”, “Always in Stock”, “Always Great Prices” for all orders placed on our Transactional Site. Always fresh – For any issue related to the freshness of a product, the customer is invited to go to the checkouts of the Designated Store within 72 hours following the pick-up of the order to obtain a refund on the amount of said product. Always in stock – For any unavailable product announced in the flyer, the customer is invited to go to the checkouts of the Designated Store within 72 hours following the pick-up of the order to obtain a deferred voucher, and an additional 10% discount on the missing product. Always great prices – the same savings are available in-store and online.

Applicable taxes and deposits will be estimated when you place your order and the actual figures will be calculated based on the actual price of your order at the time of final payment.

Payment: When you order on the Transactional Site, you need to provide your credit card payment information for your order to be submitted. Considering there could be price differences between the time your order is submitted to Metro and its assembly, we reserve the right to apply the estimated total amount of your order on your credit card plus 15% when you place your order. When your order is assembled, the Designated Store will charge the actual price of your order to your credit card.

The actual price of your order may differ from the estimated price when the order was placed due to product unavailability, substitutions, prices, discounts, promotions and coupons that may vary from one Period to another and according to those in force at the Designated Store, and products sold by weight.

Should your order not be approved during the pre-approval process, you will receive a message inviting you to contact Metro Customer Service to rectify the situation. If your payment is refused by Metro, the acquirer, issuer or financial institution and in the absence of an alternative arrangement, your order will not be completed and Metro shall have no further obligation in this regard. In giving us your credit card payment information, you represent and warrant that you are the cardholder of that credit card.

Assembly fees and minimum purchase requirement: Every order on our Transactional Site is subject to a minimum purchase requirement of $35.00 before taxes and assembly. Assembly fees are added to all orders plus applicable taxes. Metro reserves the right to change these fees and the minimum purchase required.

Refunds and exchanges: You may return products at the time of pick-up of your order. After pick-up, you may, depending on the Designated Store’s refund and exchange policy, exchange or return any product in person at the Designated Store or by using our online refund tool available directly in your account’s purchase history. For more information, please see our FAQ. Exchanges or returns by mail or other means of delivery shall not be accepted.

Limitation of liability

Metro shall not be liable for any loss, damages or claims of any kind, either direct or indirect, incidental, exemplary, special or consequential, including the loss, alteration or communication of any data, any delay, force majeure, product/service price or attribute errors, product errors, substitutions, missing products, inaccurate product/service descriptions (collectively "damages"), whether or not it has been informed of the possibility of such issues resulting from the use of this Site and/or any unassembled orders (other than refunding the order if it was paid for).Your sole and exclusive remedy is to discontinue using this Site and/or to ask, in person at the Designated Store, for a refund or exchange of the products in question depending on the Designated Store’s refund and exchange policy. No information on this Site may be construed as creating any warranty not expressly stipulated in these Terms. This limitation of liability also applies to Metro’s program Choose Better, Live Better and is also to the benefit of our partner SPINS.

Use of information and errors

The information displayed on the Site is provided for informational purposes only, unless otherwise stated. Metro makes no warranties, either express or implied, that the quality of the offers will meet your expectations and that the information, which includes advertising as well as nutritional and health tips, is appropriate to your needs and health condition.

Metro is proud of the Site and works hard to keep it updated and error-free. However, price errors or product/service description errors or inaccuracies, including colour, origin, category or other characteristic may occur. Metro reserves the right 1) to correct any such errors, at its sole discretion, at any time and without prior notice and 2) to refuse, cancel or correct any order containing such price or description errors or inaccuracies.

Communications: Metro reserves the right to communicate with you via your account contact information regarding your orders.

Order history: The Site allows you to view your online order history going back up to 12 months. Metro does not guarantee order history accuracy. For further information, contact Customer Service at 1‑866‑595‑5554.

Product descriptions: Product descriptions and information are drawn from information provided by product suppliers who are solely responsible for these statements.

Governing law

For any use of this Site and orders made in Ontario, you agree that the laws of Ontario and the applicable laws of Canada, without reference to principles of conflict of laws and excluding the United Nations Convention on Contracts for the International Sales of Goods, shall apply. You agree to be bound by such laws and to submit to the exclusive jurisdiction of the courts of Ontario, sitting in the judicial district of Toronto, with respect to the interpretation or application of these Terms.
